Trump v Anderson Ballot Access Case

In late 2023, a number of state secretaries of state and partisan actors attempted an end-run around the Constitution, in an attempt to keep Donald Trump off of 2024 primary election ballots. Under the guise of Section 3 of the 14th Amendment (previously used only to keep former Confederates from running for office), they argued that President Trump could not appear on their states’ primary election ballots.

Policy Issues Institute filed an amicus brief with the Supreme Court, joining the successful argument that states could not determine eligibility for federal office, and thus preserving the right of Americans to vote freely for candidates of their choice.
